Preamble: We the members of the Titled Kilt Memorial Fantasy Football League, in order to form a more stable League and stop the constant bickering and douchebaggery decided to put to paper all the rules and regulations that come with the immense honor of being a member of this fine league.

 

Article I. Membership, Cost of Membership & Payment

 

Section 1: The composition of membership for the Titled Kilt Fantasy Football League, hereafter referred to as the ‘A’ League, shall be ten (10) members. The TKM Developmental League, hereafter referred to as the ‘B’ league, shall consist of an even number of teams between eight (8) and sixteen (16). As of 2015, the TKM Developmental League has been disbanded.

 

Section 2: The cost of membership to the League shall be determined each year by a plurality of the League members.  The cost of membership may increase each year but by no more than 10 dollars.

·         The Current Cost of Membership (2016) is $40. Of this fee, a minimum $25 will be put towards cash awards and the rest will be used for miscellaneous league expenses.

           

Section 3: Payment of the membership fee shall be tendered by each member at the time of the draft lottery.  If the member fails to tender the payment within two (2) weeks following the draft lottery, the League reserves the right to begin contacting individuals on the Waiting List for replacement. If the membership fee has not been paid by the start of the draft, the non-paying member will forfeit the eighth round pick of the draft.

 

Article II. Ownership

           

Section 1: Ownership of a membership lies in the hands of the League.  A member may not give or sell their ownership rights to anyone.  If a member wishes to leave the League, they shall report their decision to the Commissioner, in writing, which will in turn alert the other members of the League and begin to contact individuals of the Waiting List in search of a replacement.

 

Section 2: In order to prevent a conflict of interest, a league member may not be in a spouse, girlfriend, boyfriend, significant other, or butt buddy of another league member. Relationship status will be determined by Facebook or at the discretion of the league commissioner.

 

Exception No. 1: Relationships began prior to the ratification of this constitution (e.g. Alex Kardomateas and Christopher Rivers’ relationship) are exempt from this clause.

 

Exception No. 2: This section only applies to membership of the ‘A’ League.

 

Section 3: If a league member relocates to outside of the Atlanta area and is no longer able to make mandatory league events, such as the live draft, league membership shall be revoked at the end of the season or immediately if the relocation occurs in the offseason. The Commissioner will immediately alert the other members of the League and begin to contact individuals of the Waiting List in search of a replacement for the upcoming season.

 

Article III. Voting, League Conduct and Removal Procedures

           

Section 1: Email shall be the formal method of communication for all league communication. League members are responsible for providing the commissioner with an active email address and to monitor it for league news and events.

 

For all formal votes in hearings, amendment attempts, and impeachment proceedings, active league members are expected to make their best effort to attend/respond. Proxy voting will not be permitted.

 

Section 2: All active members of the League are expected to conduct themselves in a manner consistent with not being a complete asshole.  This code of ethics includes, but is not limited to: setting your best possible lineup each week; not dropping players out of anger, frustration, or resentment; not partaking in collusion of any sort.

           

Section 3: The only time it is permissible to not start a player is if you are currently ahead of your opponent in points, and he has no remaining players for the week.

 

Section 4: A violation of this code of ethics can result in either a fine, not to exceed ½ of the entry fee for the year, or in severe or repetitive cases, removal from the League.  Any active member can report a violation to the Commissioner who will investigate and discuss the case, making sure to hear from all affected parties and will then rule on the verdict.  If the Commissioner believes that removal is the appropriate recourse, then a full hearing of all ten members will take place, in which the Commissioner will be the presiding officer.  In the event that the Commissioner is an involved party, a three person panel of league members will fill in for his absence.  The accused League member is entitled to either represent himself or seek counsel from any other active League member.  Removal requires a vote for removal from 2/3rds of the active League members.

 

Section 5: The holder of the tenth membership spot in the league will be a nonvoting member

 

Subsection a: As of the 2016 Season, Alex Kardomateas is the current holder of the 10th league spot.

 

Article IV. Commissioner Power, Regulation, & Impeachment

 

Section 1: The Commissioner shall be elected by a plurality vote.  His term shall be in perpetuity.  

 

Subsection a: At the end of a season, a new election for commissioner shall be held if petitioned by at least 3 league members. The elected commissioner will begin his term immediately following the vote.

 

Subsection b: In the event that the Commissioner resigns or is impeached, an immediate emergency election shall convene at the earliest possible time.

 

Section 2:  The Commissioner must have been a member of the League for at least three (3) consecutive seasons.  

 

Section 3: The Commissioner is entrusted with the day to day decisions of the League.  All questions of ambiguity shall be directed to him and his decisions are final.  In matters in which the Commissioner is an involved party or is directly affected by the outcome, the panel of three league members selected at random will resolve the dispute in question with a majority vote.  The Commissioner is responsible for collecting the membership dues at the beginning of the season, holding said dues throughout the season, and distributing the funds at the conclusion of the season. 

 

Section 4: The Commissioner shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, Rigging, Cheating, Fraud, Embezzlement or other high crimes. Impeachment proceedings shall begin if 1/4th of the League deems necessary and reports so to the full league body. An impeachment is successful if greater than 3/4ths of the League vote for removal. 

 

Article V. Draft Lottery and Draft

           

Section 1: The Draft Lottery shall commence at a time of the choosing of the Commissioner and ratified by the active League members.  The Lottery shall be deemed valid if no less than five (5) total League members are in attendance.  The method of the Lottery shall be determined by the commissioner. The Lottery method must be random.

 

Section 2: The Draft shall commence on a Date decided by the commissioner and vote of the active League members.  The Draft shall never be administered on a day further than thirty (30) days from the start of the NFL opening game.  The date of Draft must be ratified at least seventy-two (72) hours prior to the start of the Draft. In extenuating circumstances this clause may be disregarded by a unanimous vote of the active League members. The Draft shall operate in standard “snake” formation. The Draft shall last sixteen (17) rounds, with each League member given two (2) minutes for each draft selection.  At the end of the two (2) minutes, if a selection has not been made, the next league member in the queue will be able to make a selection. 

 

Section 3: If at least ¾ of the League can attend a “Live in person draft,” then the draft shall be conducted live and in person with the unavailable players participating via internet, phone, or other technological advancements.  If less than ¾ of the League is available for a “Live in person draft,” then the Draft shall be done “Live Online”. 

 

Section 4: A trade of draft picks shall be allowed at the mutual agreement of all involved league members. The trade must be submitted to the commissioner in writing the earlier of a) 48 hours before the draft or b) whenever the team name stickers are affixed to the draft board.

 

Section 5: The commissioner shall host the draft unless another member volunteers. The host of the draft will be responsible for purchasing the Draft Board and player labels. The Draft Board must be the 10 Team REGULAR Size Football Draft Board + 504 NFL Standard Labels from FJfantasy.com. The board shall be 42” x 48” freestanding and hold 10 teams and up to 23 rounds. The labels and board must have a readable distance of at least 15 feet. The board from FJfantsy.com is no longer available, a similar board may be chosen. The league historian must ensure that the previous years’ draft boards are at the draft.

 

Article VI. Playoffs

           

Section 1: The playoffs shall be comprised of the four (4) teams with the highest winning percentage during the regular season.  In the event of a tie, the team with the higher “Points For” throughout the season will be selected.

 

Section 2: The playoff bracket seeding and rounds are to be determined by the Commissioner prior to the draft lottery. 

 

Article VII. Payment of Spoils

           

Section 1: All funds collected each year are to be paid out in full to active League Members at the end of the fantasy football season.  The “split” is to be determined by the Commissioner prior to the draft lottery. 

 

Section 2: There shall be an end of the season league event to pass out the money and league prizes. All league members should make their best effort to attend, especially the league champion, runner up, loser and commissioner.

 

Section 3: The owner of the worst team shall be required to purchase a round of drinks for all active league members who attend the end of season celebration.

 

Article VIII. Responsibility of the Winner

 

Section 1: It is the responsibility of the winning member to have the League trophy engraved with his name and year.  Failure to do so will result in an additional fee added to the winner’s membership fee the following year equal to the cost of engravement plus $10 for punitive damages.  In the event that the winner does not return to the League the next year the cost of engravement will come from the collective pool of membership fees.

           

Subsection a: The engravement must match the prior year’s engravement as closely as possible in font and order     

 

Section 2: It is the responsibility of the winner to care for the wellbeing of the trophy.  Any damages or replacement fees will be the responsibility of the winner. In the event that the winner does not return to the League the next year the cost of damages or replacement fees will come from the collective pool of membership fees.

 

Article IX. Trades

 

Section 1: All trades may be voted against by any of the ten (10) league members. If a trade receives four votes against it shall be vetoed. League members have 48 hours to review and approve/veto a trade

 

Section 2: If a trade involves a player who is needed before the full 48 hours review period has expired, the commissioner may expedite the trade.

 

Subsection a: It is the commissioner’s discretion to determine if there has been sufficient time and ability for league members to review the trade.

 

Subsection b: A trade may only be expedited if at least 12 hours has passed in the review period.

 

Subsection c: If a trade has two or more votes against, it may not be expedited. If the trade involves the commissioner and has one or more votes against, it may not be expedited.

 

Section 3: The trade deadline is to be set at the beginning of each year by the Commissioner.  It can be changed throughout the year with a 3/4ths vote.

 

Section 4: Trades may only involve players currently on league members’ roster. Trades may not involve future draft picks or waiver position.

 

Article X. Waiting List & Addition to the League

           

Section 1: The Waiting List shall be comprised of eligible individuals in the ‘B’ League that wish to gain entry to the ‘A’ League.  The members of the list shall be voted on by the current members of the League to determine the ranking order of the list. 

           

Section 2:  When a vacancy in the League develops, a final vote on the League Waiting List order will be administered.  The highest ranked individual will be offered admission into the League.

 

Section 3: If at any time any current member of the League believes that a member of the Waiting List is unfit to be an active member of the League he may motion to have that person’s name removed from the waiting list.  If the motion is seconded, then a vote will take place.  If ¼ of the league believes the individual in question is unfit to be an active member, than that individual’s name will be removed from the Waiting List for a period no greater than one (1) year.   

 

Article XI. Amendments

           

Section 1: In order to amend the League constitution in any way, shape, or form, a 3/4ths vote is necessary.  The amendment must be in written in an email and distributed to all members of the League prior to any vote. Changes to League Rules or Scoring in Article XIII only require a simple majority vote.

 

Section 2: If a league or scoring rule from Article XIII has been implemented in the ‘B’ league, amendment requires only a simple majority vote.

 

Section 3: Midseason Amendments to the League Constitution or Rule changes may only be passed by unanimous vote.

 

Article XII: Ratification

           

Section 1: A 3/4ths vote of the current members of the League shall be sufficient for the Establishment of this Constitution. As of the 2014 Season, the Constitution has been ratified.
